TERMS AND CONDITIONS
Kibo Integral Tech Private Limited, (hereinafter referred to as ‘us’, ‘we’, ‘our’ or ‘Company’) which term shall be deemed to mean and include the successors in business, employees, agents, assigns, commissioned contractors) provides an on-line platform (Step Up by Turant) for domestic consumers to transact with third party sellers.
Step Up by Turant is intended to be a platform for end-consumers desirous of purchasing speciality branded and unbranded product(s) for domestic self-consumption. If you are a retailer, wholesaler( whether individual, firm or company), you are eligible to use Step Up by Turant to purchase products from third-party sellers on the same terms & conditions that this platform/service is offered to individual customers, who have been granted access to Turant Step-up to display and offer their products for sale through Step Up by Turant
This Service is India specific. If you are located outside India, you should not access this service. The Company, in its sole discretion and without liability, reserves the right to terminate or refuse your registration, or refuse to permit use/access to Step Up by Turant , if: (i) it is discovered or brought to notice that you do not conform to the eligibility criteria, or (ii) the Company has reason to believe (including through evaluating usage patterns) that the eligibility criteria is not met/is violated by a user, or (iii) may breach the terms of this User Agreement.
ACCOUNT & REGISTRATION OBLIGATIONS FOR PURCHASES
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
As part of the registration process at Step Up by Turant, the Company may collect personally identifiable information about you, including but not limited to Name , email address, age, address mobile phone number and other contact details, demographic profile (like your age, gender, occupation, education, address etc.)
When you visit Step Up by Turant, you are communicating with us electronically. You will be required to provide a valid phone number while placing an order with us. We may communicate with you by SMS, phone call or by posting notices on the Mobile Application, through our In App Chat facility or by any other mode of communication. For contractual purposes, you consent to receive communications including SMS, or phone calls from us with respect to your order.
If you wish to purchase any product or service made available through Step Up by Turant (“Purchase”), you may also be asked to provide certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.
LICENSE AND MOBILE APPLICATION ACCESS
The Company grants you a limited license to access Step Up by Turant for personal use. Such limited license does not include/permit any resale or commercial use of Step Up by Turant or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of Step Up by Turant or its contents; any downloading or copying of information for the benefit of another third party; or any use of data mining, robots, or similar data gathering and extraction tools;caching, unauthorized hypertext links to the Turant Mobile application and the framing of any Content available through the Turant Mobile Application. You may not bypass any measures used by the Company to prevent or restrict access to the Turant Mobile Application. Any unauthorized use by you shall terminate the permission or limited license granted to you by the Company.
The Company aims to ensure that prices of all products offered for sale are true and correct. However, from time to time, the prices of certain products may not be current or may be inaccurate on account of technical issues, typographical errors or incorrect product information provided to the Company by third-party seller. In each such case, notwithstanding anything to the contrary, the Company reserves the right to cancel the order without any further liability.Subject to the foregoing, the price mentioned at the time of ordering a product shall be the price charged at the time of delivery, provided that no product offered for sale on the Step Up by Turant will be sold at a price higher than its MRP (Maximum Retail Price). In case , because of a technical error or a glitch, the listed price is higher than the MRP, the Customer is requested to bring such error to the attention of the Company, and the Company shall refund any such excess amount inadvertently charged to the Customer, after confirming the corrected MRP of the Product.
THIRD PARTY WEBSITES
The Turant Mobile Application may contain links to third party Apps/websites that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party websites. In addition, the Company will not and cannot censor or edit the content of any third party site. By using third party website, you expressly relieve the Company from any and all liability arising from your use of this Website and any third party website as aforesaid. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
OWNERSHIP OF CONTENTS AND INTELLECTUAL PROPERTY RIGHTS
The Turant Mobile Application contains material, such as software, text, graphics, images, designs, sound recordings, audio-visual works, photographs, Product descriptions and other material provided by or on behalf of the Company (collectively referred to as the “Content”). Unauthorized use of the Content may violate copyright, trademark, and other laws. You have no rights in or to the Content, and you will not use the Content except as permitted under this Agreement. No other use is permitted without prior written consent from the Company. You may not sell, transfer, assign, license, sublicense, or modify the Content or reproduce, display, publicly perform, make a derivative version of, distribute, or otherwise use the Content in any way for any public or commercial purpose. The use or posting of the Content on any other website or in a networked computer environment for any purpose is expressly prohibited.
Step Up by Turant is a platform for domestic consumers to transact with third party sellers, who have been granted access to Step Up by Turant to display and offer Products for sale through the Turant Mobile Application.
It is emphasised that the Company does not provide any services to users other than providing Step Up by Turant as a platform to transact at their own cost and risk, and other services as may be specifically be notified in writing.
You agree and acknowledge that Company s only a facilitator and is not and cannot be a party to or control in any manner any transactions on the mobile Application. Consequently, the Company has no control, involvement or influence over the products purchased by you from such third party sellers or the prices of such products charged by such third-party sellers. Accordingly, the contract of sale of products on the Turant Mobile Application shall be a strictly bipartite contract between you and the sellers/distributors on Step Up by Turant. The Company therefore disclaims all warranties and liabilities. Services on Turant Step -up are available to only select geographies in India and are subject to restrictions based on business hours and days of third party sellers.
You are required to make the payment at the time of Check Out on the Turant Mobile Application. No orders will be delivered until full payment has been made received and Order Confirmation with Order Number generated. Payment may be made only by debit card, credit card, UPI and Net banking facilities as per the terms of the payment gateway only.
Step Up by Turant charges a nominal ‘Service Fee’ based on a sliding scale percentage of total order value, with a maximum fee of INR 15 for orders exceeding INR 5,000.In addition, Delivery Charge of INR 30 will be charged for transacted Purchases less than INR 1,500 in aggregate order value.
DELIVERY AND SERVICE CHARGE
Purchases transacted through Step Up by Turant may be available for pick up only at the store, delivered for free, or chargeable for delivery. The same will be reflected on the Product display and at the time of Check Out, when you will be required to select from available delivery or pick up time slots. You will be informed of such delivery charge at the stage of check-out for a transaction through Step Up by Turant.
It is the Customer’s responsibility to ensure that a person is available and has access to the Order QR Code for the duration of the time slot selected for delivery, at the stated address. In case we are not able to find customer at his address, and/or the customer or his representative is out of reach, Step Up by Turant retains the right to deliver said order to a suitable alternative recipient (Such as neighbor, security guard, society manager, employee) with due acknowledgement and inform Customer through the App, or over the phone by voice/SMS/WhatsApp of person delivered to.
In such an event, any spoilage of items within order, any breakage or damage to items, any theft or loss of items or entire order will be the sole responsibility of the customer.
Although we will make best efforts to deliver orders within the customer selected time slot, there is the possibility of delays or cancellations due to circumstances beyond the control of Step Up by Turant, and/or its logistics partners. In such event, you will be intimated in advance of the rescheduled time of delivery. It shall be assumed that the rescheduled delivery time is acceptable to you, unless you call Step Up by Turant to reschedule delivery at a time convenient to you or cancel your Order. We will make our best efforts to deliver your Order at the next most convenient time to yourself, contingent to availability of Delivery Partners.When your order is delivered to you, you will receive two separate invoices: one invoice against the purchase and the second invoice against service fees and delivery charges for using the Turant Software and Mobile Platform.
AVAILABILITY, ERRORS AND INACCURACIES
We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other web sites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.The Company cannot and does not warrant the exact quality of freshness of produce as may be displayed on the Turant Mobile Application. The pictures of the Products, especially produce as appearing on the Turant Mobile Application, does not represent the exact product which will be delivered to the Customer. If the Purchase is any fresh produce, the Company does not warrant the exact weight of the fresh produce as mentioned in the invoice, if such loss of weight is attributable to loss of moisture content in the fresh produce from the time the Product is weighed to the time of delivery to the Customer.
SELLING OF PRODUCTS UNDER INFRINGING TRADEMARKS ON TURANT STEP-UP
If you are a seller, you will ensure that you are selling only genuine goods, that are compliant with rules and regulations which are applicable for the product. As an ISP, we are required to comply with the provisions of the Information Technology Act. In the event the Company receives a take down notice from a third party, who validly supports their claim of being a proprietor of a trademark, and the Company is of the opinion that the trademarks of any goods sold by you infringe a registered trademark of such third party, the Company shall be at full liberty to delete/ remove/erase reference to such product on Step Up by Turant, without any liability for damages/claims or losses of seller of such infringing products. The decision of the Company is such case in final, until such Seller obtains an order of the Court, to the effect that the trademark under which the products are sold do not infringe the registered trademark of such third party who has alleged infringement.
CONTESTS, SWEEPSTAKES AND PROMOTIONS/COUPONS/PROMOCODES/OFFERS
COUPONS AND PROMO CODES
From time to time, the Company may at its discretion offer a user promotional code or coupons entitling you to encash the applicable value of such codes/coupons against purchases made at Step Up by Turant Unless specifically stated on the code or coupon, a promotional code or coupon shall:
- Expire at 12:00 AM (inclusive of the issuance date) from the date of issuance endorsed thereon;
- Have a maximum discount or cash back value as stated within the offer
At the time of using promotional codes and coupons for a purchase on Step Up by Turant, the payment mode “cash on delivery” shall not be available for making payments towards the Order.
The system limits orders based on available quantity and based on Seller. This could vary from Seller to Seller.
Customers may shop from Various stores/Sellers and pay once in aggregate at Check out. Step Up by Turant shall strive to deliver in the entire Purchase in time slots grouped by type of product and their availability. However Step Up by Turant will not be liable for any claim, damage or loss , if for any reason the Purchase is not delivered at the indicated time slot and/or the entire Purchase is not delivered at one time time slot.
CANCELLATION BY COMPANY
CANCELLATIONS BY CUSTOMER
You may cancel your order, free of cost, upto 12:00am/00. 00hrs Midnight on the day prior to scheduled delivery date for your order.
In case of cancellation of your order, whether partial or complete, between 12:01am/00:01hrs to 06:00am/0600hrs on the day of delivery, a cancellation fee is deducted at a minimum of INR25 and can be higher depending on the size of the cancelled order and proximity to selected delivery slot. At no time will the cancellation fee be higher than the value of the cancelled order.
Subject to the terms and conditioned mentioned hereunder, as a user, you may not cancel an order placed by you after 6.00a.m/06.00hrs on the day of delivery of your Order.
You agree that cancellation request of orders shall not be entertained once Purchase are delivered, irrespective of whether or not such delivery is complete delivery or partial delivery, unless the Product is defective.
No orders can be returned directly to the Delivery Partner. The Customer has to report an issue through Step Up by Turant’s ‘Report Issue facility’ to address problems with the order or specific item/s contained in the order.For any permitted cancellations, made by you under the relevant order, we will refund payments, if any, within approximately 2-7 days.
RETURNS AND REFUNDS POLICY
Sale items cannot be returned, and no refund can be claimed unless damaged missing/defective/incorrect/expired and/or tampered with.
In case of defective product, replacement request has to be initiated by Customer through ‘Report Issue’ on Turant Mobile Application within 6 hours of receipt of Purchase. and contact the Seller directly.
If return or replacement is accepted by the Seller, the defective Product will be collected free of charge from Customer. At the Seller’s discretion, the Seller may either replace the Product or give a similar product if acceptable to the Customer or give a refund or wallet credit in lieu of replacement, if replacement is not available for any reason.
To be eligible for a return, please make sure that:
The product was purchased within the time lines stipulated above
The product is in its original packaging
The product isn’t used or tampered with.
You have the receipt or proof of purchase
You may be asked to provide a photo of the defective Product/s within the In App Report Issue process
You will be required to return said defective Product to our Delivery Partner during a pre-designated time slot which will be communicated to you with sufficient notice. The return of the defective product is mandatory irrespective of whether the Issue Reported results in a Replacement/Refund or Wallet Credit.
If you are unwilling, or unable to return said Product, or we find a substitute has been returned in place of the original Product supplied, we reserve the right to debit your account with the full list price/MRP of said Product, and delivery/service charges that may have been refunded, and also charges for pick-up of defective product as appropriate.
Products that do not meet these criteria will not be considered for Replacement/ /Refund/Credit.
Replacement/ /Refund/Credit will not be considered unless the Product(s) to be returned to the Seller is/are returned in its original packing and the receipt or proof of purchase at the address mentioned in the original delivery challan/invoice/order.

Your orders will be fulfilled in line with the GST guidelines. Once your order is delivered to the address mentioned in the Purchase order, you can access both the Delivery Challan & GST Invoices under Your Account section of the mobile application. This will contain Tax Invoices showing all the items and respective taxes and a services invoice of our fees.
REVIEWS, FEEDBACK, SUBMISSIONS:
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.If you have failed to cancel an open Order before commencement of charged cancellation period, at the time you suspend/terminate your account, your refund will be processed after deduction of appropriate cancellation fee as listed by respective Seller.
ACCESS TO STEP UP BY TURANT /SERVICE/WEBSITE
We will do our utmost to ensure that service through the Turant Mobile Application is uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the Website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction.
LIMITATION OF LIABILITY
In no event shall the Company nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, damage or loss to person, claims, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) from use or consumption of any Products/goods purchased from third party seller at the Step Up by Turant(ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; (iv) your access to or use of or inability to access or use the Service; (v) unauthorized access, use or alteration of your transmissions or User Content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
Your use of Step Up by Turant is at your sole risk and you are using your best and prudent judgement before entering into any transactions. Step Up by Turant is provided on an “AS IS” and “AS AVAILABLE” basis. The Company make best efforts to display available products, including in respect of their colour, size, shape and appearance, as accurately as possible, if not a product description is given as accurately as possible. However, the actual colour, size, shape and appearance may have variations from the depiction on your mobile/computer screen. The Service is provided without warranties of any kind, other than those carried by the Products themselves, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance nor does the Company implicitly or explicitly support or endorse the sale or purchase of any products at the Step Up by Turant. The Company accepts no liability for any error, inaccuracy or omission of third parties or for information/inputs received from third parties and provided to you through the Step Up by Turant or otherwise. You acknowledge and agree that the Company shall not, at any time, have any right, title or interest to any product(s), which is subject to a bipartite sale and purchase contract between you and the relevant third party seller. The Company does not have any control over the quality, failure to provide or any other aspect whatsoever of the product(s) and is not responsible for damages or delays on account of products which are out of stock, unavailable or back ordered.Further, the Company its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
EVENTS BEYOND OUR REASONABLE CONTROL
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
These Terms shall be governed and construed in accordance with the laws of Maharashtra, India, without regard to its conflict of law provisions. You agree as we do to submit to the exclusive jurisdiction of the Courts in Mumbai.Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.
